Digital Millennium Copyright Act (DMCA) Policy
Welcome to Finance TopFeed. We respect the intellectual property rights of others and expect our users to do the same. In compliance with the Digital Millennium Copyright Act (DMCA), Title 17 of the United States Code, Section 512(c), a copyright owner or their authorized representative may submit a takedown notice to our designated DMCA Agent as outlined below. As an Internet Service Provider, we are entitled to claim immunity from infringement claims under the DMCA’s “safe harbor” provisions. To file a good-faith claim of copyright infringement, you must submit a notice containing the following information:
Notice of Infringement – Claim
To file a notice of infringement, please include the following information:
- A physical or electronic signature of the copyright owner (or someone authorized to act on behalf of the copyright owner).
- Identification of the copyrighted work that is claimed to have been infringed.
- Identification of the infringing material to be removed and information reasonably sufficient to allow the service provider to locate the material. [Please include the URL of the page in question to help us identify the allegedly infringing work].
- Information reasonably sufficient to permit the service provider to contact the complaining party, including your name, physical address, email address, phone number, and fax number.
- A statement that the complaining party has a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
Penalties for Misrepresentation
Title 17 U.S.C. §512(f) provides civil penalties, including costs and attorney fees, against any person who knowingly and materially misrepresents information in a notification of infringement under 17 U.S.C. §512(c)(3).
Where to Send Notices
Submit all takedown notices through our Contact page. For prompt attention, email is preferred.
Please note that we may share the identity and information in any copyright infringement claim we receive with the alleged infringer. By submitting a claim, you understand, agree, and consent to this sharing of your identity and claim details with the alleged infringer.
Counter-Notification – Restoration of Material
If you have received a takedown notice regarding material on our site, you may submit a counter-notification to dispute the claim and potentially restore the material in question. This notification must be submitted in writing to our designated DMCA Agent and must include the following, in compliance with Section 512(g)(3) of Title 17 of the U.S. Code:
- Your physical or electronic signature.
- Identification of the material that was removed and the original location of the material before it was removed.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, to the jurisdiction of any judicial district where the service provider may be found), and that you will accept service of process from the person or company who provided the original infringement notification.
Where to Send Counter-Notifications
Submit your counter-notification through our Contact page. Email is recommended for quicker processing.
Repeat Infringer Policy
We take copyright infringement seriously. In accordance with the DMCA’s requirements for repeat infringer policy, we maintain a list of DMCA notices from copyright holders and make a good-faith effort to identify repeat offenders. Users who violate our internal repeat infringer policy will have their accounts terminated.
